I. Contract

Reservations: There are two ways you can book your accommodation with Europe-Mountains.com:
  • First option: You select the arrangements you’re interested in, provide the details to our website and send us your request. You’ll receive an e-mail offer with a link to follow the booking procedure. Information about services included and not included in the total price is included with the e-mail offer. Some of the services (e.g. local taxes, final cleaning, security deposit) are not included in the total price and have to be paid on the spot (these will be explicitly stated on the travel documents provided by us).
  • Second option: You make an on-line booking directly through our website. Once you’ve selected the arrangements you wish to book, you provide the details to our website, including the payment details via a 100% secure SSL webpage, and submit all of this to us. Information about services included and not included in total price will be stated on our website. Some of the services (e.g. local taxes, final cleaning, security deposit) are not included in the total price and have to be paid on the spot (these will be explicitly stated on the travel documents provided by us).
Every time a reservation is confirmed, we’ll send an e-mail with the document(s) which confirm your booking. A binding contract will come into force between you and our company at the moment we send out our confirmation e-mail, and until then we shall be under no liability to you whatsoever. Please note that by sending us payment details, you accept the cancellation policy given on Europe-Mountains.com, on each property’s webpage in the terms field. If we’re unable to accept your booking, we will never process your payment. In case there are any changes to the details you’ve supplied to us, it is your responsibility to inform Europe-Mountains.com by contacting our Reservations Department as soon as possible.

Payment: For most of the properties available through our system, we require a 30% prepayment at the time of booking in order to confirm your stay. The outstanding balance shall be paid within 6-8 weeks before travelling. Exact payment information is given on Europe-Mountains.com, on each property’s webpage in the terms field. Methods of payment:
  • Cash: Europe-Mountains.com does not accept cash payments.
  • Credit Cards: We welcome payment by Visa and MasterCard. Customers choosing to use a card as a method of payment will be subject to a handling fee of 3% of the Total Stay Price.
  • Bank transfers: There’s also the option to pay by bank transfer. If you wish to choose this method of payment, you’ll need to contact our Reservations Department:

Confirmation Documents: Europe-Mountains.com’s confirmation documents will be provided for each booking made with us:
  • Reservation Confirmation Letter – document received after prepayment
  • Final Payment Confirmation – document sent after the outstanding balance payment, confirming the Total Price that was charged for your reservation
  • Final Confirmation Voucher – document sent together with Final Payment Confirmation, which you’ll present to the relevant supplier (see details on voucher) upon arrival.
  • Booking Confirmation Letter – document sent in case the outstanding balance payment occurs directly at the hotel/residence, which you’ll present to the relevant supplier (see details on confirmation letter) upon arrival.
It is your responsibility to check the document(s) and ensure that all of the details are correct. When sending the confirmation document(s) to you, we always ask you to review the document(s) and send us a brief e-mail as a receipt. However, not sending a confirmation of the data’s accuracy doesn’t influence the fact that the reservation is made the moment we send you the confirmation document(s). Accommodation and services will only be provided in accordance with the details in the confirmation e-mail. In case the details on the document(s) are incorrect, you should contact us immediately after receiving the document(s):

Changes made by the Customer: If you wish to make a change to your booking, you must notify us by e-mail or in writing. We will endeavor to make the change, but this is subject to availability. If the change is possible, you’ll be asked to pay an administration fee of 25 EUR per change, and you’ll also be responsible for any charges imposed by the suppliers of your arrangements as a result of the change.

Changes made by Us: We undertake to provide the accommodation booked by you. In the event that you cannot be accommodated in the reserved lodgings, we’ll accommodate you at a comparable or better location of at least equal standard and equipment. Any additional and supplementary costs shall be borne by us. Any deficiencies in accommodation must be brought to our attention without delay. Deductions, if any, shall be subject to a written comment deemed to be received by us within 35 days from the departure date at the latest, and agreed to by us in writing. Regarding all travel arrangements, we will not assume any responsibility for impaired performance (e.g. insolvency, etc.) not caused through our fault, or caused by force majeure.

Cancellation by the Customer: If you cancel your booking, there may be cancellation charges. Cancellation fees differ between the products offered, and are visible on most Europe-Mountains.com websites. If there isn’t a cancellation policy on the Europe-Mountains.com property webpage, the conditions are as follows: Cancellations made more than 55 days prior to arrival – 30% cancellation fee. Cancellations made 55 – 42 days prior to arrival – 50% cancellation fee. Cancellations made 41 – 29 days prior to arrival – 70% cancellation fee. Cancellations made 28 – 22 days prior to arrival – 80% cancellation fee. In case of cancellations made less than 21 days and no-shows – 100% of the Total Price will be charged. Should you wish to cancel your booking, the person who made the booking must notify Europe-Mountains.com by e-mail at: by fax or via our customer panel.
Each cancellation request has to reach us by 14:00 on a working day in order to start the process. In case your request reaches us after 14:00 or during the weekend, it will be deemed as received on the following working day. Europe-Mountains.com will then send you a written confirmation of your cancellation and provide a refund according to the cancellation policy stated on the confirmation document(s).

All charges will be made in Euro (EUR) or Polish Zloty (PLN), according to the National Polish Bank (NBP) exchange rate from the previous working day. All of the exchange calculations will be presented to the client before the payment proceeds.


II. Our responsibilities
Our Liability to You

Our obligations, along with those of our suppliers providing any service or facility included in your holiday, are to arrange and provide such services and facilities with reasonable skill and care (where we or our supplier is actually providing the service or facility). You must show that reasonable skill and care has not been used if you wish to make any claim. Please note that standards such as safety, hygiene, quality, etc. vary throughout destinations that your holiday may involve. Sometimes, these standards will be lower than those which would be expected in your own country of residence. The services and facilities included in your holiday will be deemed to be provided with reasonable skill and care according to any local regulations which apply. In case there are no applicable local regulations, the services and facilities should comply with local standards and customs.

Claims which do not involve death or personal injury Europe-Mountains.com accepts and will only have liability (subject to paragraphs 4 and 5 below) should we or our suppliers fail to satisfy the obligations detailed in paragraph 1 above. If we have liability, we will (subject to paragraphs 4 and 5 below) pay you compensation. The maximum amount of compensation will be a refund of all expenses you have incurred with us (excluding any amendment charges). However, we will pay you compensation of an amount which could be reasonably expected, taking into account all of the relevant circumstances.

Claims which involve death or personal injury As a result of an activity forming part of your holiday, Europe-Mountains.com accepts and will only have liability (subject to paragraphs 4 and 5 below), should we or our suppliers fail to satisfy the obligations detailed in paragraph 1 above. If we have liability, we will pay you reasonable compensation (subject to paragraphs 5 and 6 below).

We have liability in accordance with paragraphs 2 and 3 above and subject to paragraphs 5 and 6 below. However, Europe-Mountains.com has no liability when the cause of the failure to provide, or failure in, your holiday or the cause of any death, personal injury, loss or damages you may suffer, is not due to any fault on our part or that of our employees, agents or suppliers. Circumstantially. it is either attributable to you or to someone unconnected with your holiday and is unforeseeable, unavoidable or due to unusual or unforeseeable events beyond our control, the consequences of which could not have been avoided, even if all due care had been exercised. Europe-Mountains.com, our employees, agents or suppliers have no liability in case of an event that we could not have foreseen or forestalled.

If any international convention applies to, or governs, any of the services or facilities included in your holiday arranged or provided by us (or any of our suppliers), and you make a claim against us of any nature arising out of death, injury, loss or damages suffered during or as a result of the provision of those services or facilities, Europe-Mountains.com is liable to pay you compensation. The amount (if any) of compensation payable to you by us, will be limited in accordance with and/or in an identical manner to that provided for by the international convention concerned (in each case, including in respect of the conditions of liability, the time for bringing any claim and the type and amount of any damages that can be awarded). This means that we are to be regarded as having all of the benefits of any limitations upon compensation contained in any of these conventions, or any other international conventions applicable to your holiday.

If you choose to issue court proceedings in respect of a claim against us, you must do so within 1 (one) year of your return from the holiday in question, or within 1 (one) year of first discovering the matters giving rise to the claim, if this is later. Otherwise, our liability to you will be limited in all cases to a sum of 100 EUR.

If we are adjudged to have, or if we accept, liability for a claim that you make, you are obliged to assign to us any rights that you may have against any of our employees, agents or suppliers which is in any way responsible for the failure of your holiday or any death or personal injury you may suffer. You must also cooperate with us in any claim we choose to bring against any third party which we, in our discretion, deem to be responsible.

Other than as set out above, and as is detailed elsewhere in these booking conditions, we shall have no legal liability whatsoever to you for any loss, damages, personal injury or death which you suffer arising directly or indirectly from any aspect of your holiday.


III. Your Responsibilities

Reservations: Our website will not stop you from making impossible bookings, such as reserving 2 (two) hotels in different places for the same dates, or a hotel in one place and a ski rental in another. If you make this kind of double booking, we are unable to give you a refund. It is your responsibility to ensure that all bookings made with us will be travelled. Our reservations staff will strive to inform you about double bookings if any occur, but we cannot be responsible for such bookings in any way.

Personal responsibility: When you book with us, you accept responsibility for any damages or loss caused by you or any member of your party. Full payment for any such damages or loss must be made directly at the time to the relevant supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (along with our own and the other party’s full legal costs) as a result of your actions. Europe-Mountains.com does not accept any responsibility for damages or loss caused by you or your party. We expect all customers to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any supplier or any other person in authority, you or any member of your party behaves in such a way as to cause, or be likely to cause, danger, upset or distress to any third party or damage to property, we and/or the relevant supplier are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. Neither we nor any supplier will have any further responsibility toward such person(s), including any return travel arrangements. No refunds will be made and neither we nor any suppliers will pay any expenses or costs incurred as a result of the termination.

Insurance obligation: Each client is supposed to insure themselves against all risks related to the holidays, services or facilities provided by Europe-Mountains.com (or any of our servants, agents or suppliers), such as robbery, loss or destruction of their personal items, as well as against any damages or loss caused by the client or his party, as stated in paragraph 2.

Age of the lead customer: It is the criteria of Europe-Mountains.com that the lead customer must be over 18. By ticking the box to confirm that you have read and understood the Terms and Conditions, you are also confirming that the lead name for the booking is over 18 years of age.

Passport, Visa and Health Requirements: It is your responsibility to make the necessary applications and to comply with any regulations governing entry into your chosen country. If you do not obtain a visa, where this is required, or your passport or any other travel documentation is not in order and you are unable to travel as a result, you will be liable to pay the cancellation charges set out in Europe-Mountains.com’s reservation confirmation documents. Furthermore, we will not accept any responsibility or refund any money in case you are unable to travel because of an invalid or mislaid visa or passport. Non-EU citizens are advised to check with their embassy or consulate to obtain details about the relevant requirements.

Complaints: If you are in any way dissatisfied with any aspect of your arrangements (i.e. quality, tidiness, disrepair), you are obliged to inform in writing the appropriate employee, agent or supplier immediately after your arrival (according to the exact terms stated in each employee’s, agent’s or supplier’s regulations). You must also notify Europe-Mountains.com within 7 days from the date your holiday commences. Otherwise, neither Europe-Mountains.com nor the appropriate employee, agent or supplier will take into consideration any complaint regarding the issues enumerated above.
